You said it weakly, and so did they! Employers have every right to stop their employees from engaging in a deadly activity. They can test to see who's been smoking, and they should! In fact, employees should be thanking this company for looking out for their best interests. How wonderful would it be if all companies were as concerned about the health of their employees? I applaud this new concept!

They should think about testing for STDs, too--if left untreated, syphilis can kill you!

Yes, and let's be sure employers restrict other risky behavior such as fatty foods, driving fast, unprotected sex, voting democratic, etc. Employers do not own their employees. It is not up to them to determine what legal behaviors they may or may not take part in outside the workplace.
